Phillips Point, the prestigious waterfront office towers on Flagler Drive, has sold for a record $200 million or $470 per square foot in one of the richest real estate deals in Palm Beach County history. The price represents a 45 percent increase over what the complex fetched just four years ago.
Even as Palm Beach County home values slump, prices of offices, warehouses and shopping centers soar, lending credence to what analysts claim is evidence of froth in the commercial real estate market. From Publix shopping centers to industrial land, investors have been throwing cash at Palm Beach County real estate. A Publix center in Greenacres sold earlier this year for $67 million, and 537 acres at the former Palm Beach Park of Commerce changed hands last month for $162 million. Two office buildings on Royal Palm Way in Palm Beach this year sold for $600 per square foot, but $470 is the peak for properties west of the Intracoastal. With commercial properties showing strength the housing market can't be that far behind it.

Facing large budget cuts as a result of tax relief proposals in Tallahassee,
Palm Beach County commissioners said today that the property appraisers'
office should be doing more to stamp out homestead-exemption fraud. The
commission agreed to send a letter to Property Appraiser Gary Nikolits
asking him to beef up efforts to catch residents who illegally claim the
$25,000 exemption. Commissioners Burt Aaronson, who called for the letter,
pointing to a May 6 Palm Beach Post article that reported efforts to catch
cheats in Palm Beach County have resulted in just 43 cases since 2004.
Investigators have collected less than $325,000 in lost tax revenue,
penalties and interest. All property owners who reside in their homes as of
Jan. 1 are entitled to a $25,000 reduction in the property's assessed value.
The exemption also prevents the assessed value from increasing by more than
3 percent each year. The assessment cap, called Save Our Homes, has saved
many homeowners thousands of dollars each year on their property-tax bills
as property values skyrocked. But it has also made it more lucrative to
cheat. Nikolits has said his office doesn't have to be as aggressive as
other counties because the majority of illegal exemptions are caught before
the designation is granted.

Plans for a major overhaul at the city marina were received warmly for the most part Monday night by city commissioners and the few members of the public who talked about them.
The project calls for expanded docks, a five- or six-story boutique hotel, restaurants and a far better financial deal for the city with the private operator, Connecticut-based Leisure Resorts. It's designed to dovetail with the city's plans to overhaul the rest of the waterfront to the south.
But some new caveats surfaced Monday, including questions about noise, traffic, security for adjacent condo residents, the extent to which boats would block water views and the look of a two-story garage in an awkward spot on Flagler Drive, which the city prizes as its most picturesque street.
Nonetheless, the plan passed, as expected, with commissioners approving three things: a site plan for the hotel, a 100-year lease extension with Leisure Resorts and a swap with the state of underwater land that's crucial to the complex deal. The lease extension needs another vote before it's final. On June 12, the state Cabinet will consider a swap of land that would give ownership of the submerged marina land to the city so the new revenues would go to the city rather than the state. If the Cabinet does not approve the swap, as anticipated, the lease extension may not gain final approval June 18. Under the new terms, that sum would rise to $180,000 or 8 percent of the marina's dock-rental revenue, which could amount to $450,000 to $600,000. Mayor Lois Frankel described it as a crowning moment after years of acrimony between the city and the marina. A development agreement approved Monday night does not require the hotel to be finished until 21/2 years after the docks are built, which could amount to a total of four years or more. The mayor would like to see a fast pace so stay tuned.

The Florida Legislature has scheduled a series of public hearings on
property tax reform throughout the state. Palm Beach County has been chosen
as one of the locations.

PALM BEACH GARDENS - For the past two hurricane seasons, officials with the
Northern Palm Beach County Improvement District have had to use a
storm-water pump station as their emergency operations center.
In the span of about 15 months, things have changed drastically. From now
on, district workers can take shelter at their own hurricane-proof building.
On Wednesday, officials held an open house for their nearly $6 million
facility. Construction started in July last year.
The morning was a festive occasion. Steel drums rang in the second floor.
Papayas adorned a buffet table just outside the meeting room, fitted with
impact-glass windows.
Still, people couldn't help but think of a much less sunnier side of the
Florida lifestyle.
"I think what's going to happen is, during the tour, a lot of people are
going to pick out their bedrooms," state Sen. Jeff Atwater, R-North Palm
Beach, joked before staffers showed visitors around the 14,000-square-foot
facility.
The last few years have offered the district - which maintains roads and
drainage for several communities from Southern Boulevard north to the Martin
County line - several lessons on preparedness.
At one point, a generator motor blew out at a storm-water pump station,
flooding the roads in the Ironhorse community off Jog Road. It took almost
three days for the station to get running again.
Then there were the stations that had to guzzle up their generator fuel,
leaving the district with no way to transfer untouched gallons of diesel
from one station to another that needed it more.
"We couldn't move them," Executive Director O'Neal Bardin remembered. "Now
we can."
The district can count on a fuel trailer and two backup generators for the
two-story facility and the 16 pump stations. Shower stalls, a washer and
dryer, and eight bunk beds mean that up to eight staffers can live there for
about a week.
The former office, across the parking lot on Hiatt Drive, was sold this year
for $2.2 million to a developer.

RIVIERA BEACH - Developer Dan Catalfumo and consultant Bernard Kinsey
unveiled a project Wednesday that goes far beyond giving the Ocean Mall a
$280 million face-lift, but provides an economic boost for the city's
predominantly black mainland.
Ocean Mall Redevelopment, the group led by Catalfumo, detailed how revamping
the 33-year-old Ocean Mall and putting a 28-story Marriott hotel/condo
building in the city's beach parking lot will make the city financially
secure for generations. Over the 99 years Catalfumo wants to lease the
city's 11 acres of beachfront, the mall's makeover is estimated to pump
nearly $2 billion into Riviera Beach's coffers, according to figures from
Catalfumo and Kinsey.
"I'm really proud of what we have here," Kinsey said. "We're going to make
sure people in Riviera Beach are participating in the economic benefit of
this mall."
The city will receive revenues from leasing the land for the hotel and the
renovated Ocean Mall. After 30 years, Riviera Beach officials will have the
right to buy out the lease on the mall.
In addition, tax revenues from the project will pump millions into the
city's Community Redevelopment Agency, which has struggled for years to
usher in a major project. The estimated tax revenues are expected to start
at $3.7 million in the first year and reach $50 million annually by the end
of the 99-year lease.
Catalfumo has also agreed to make $5 million in civic improvements,
including upgrading the city's beach area near the dunes. About $1.5 million
will go for beach improvements while an additional $3.5 million will be
spent for renovating areas within 300 feet of the project.
"We are part of this community," Catalfumo told the CRA board. "We're not
building and leaving."
However, Singer Island residents are mounting an offensive. Last Friday, a
committee was formed to gather signatures to overturn the council's decision
to increase the beach lease from 50 to 99 years.
Catalfumo told the council that there is some misinformation being
circulated by the petitioners. He encouraged people who felt they had been
misled into signing the petitions to ask that their names be removed.
Resident Gerald Ward suggested that the council get a detailed analysis of
the deal and take its time in reviewing it before voting.
The CRA has been working for about three years to get the Ocean Mall
redeveloped.
Kinsey pushed for Catalfumo to provide a community benefits package as part
of the deal. He and Catalfumo's group created a deal that ensures that the
city's black residents will play key financial roles in the project.
Under what's been dubbed the Community Benefits Partnership Program,
Catalfumo has agreed to involve Riviera Beach residents in several aspects
including:
- Employing area residents with an emphasis on recruiting people who live in
Riviera Beach.
- Hiring black people as sales and marketing representatives in the sale of
the Marriott condominiums.
- Requiring the general contractor for the retail space to award 50 percent
of its construction contracts to local businesses. This will include 25
percent of the contracts going to black-owned businesses.
- Contributing one half of one percent of the estimated construction costs to
the Community Benefits Partnership Program for neighborhood improvements.
Another half percent of the construction costs will go for cultural, civic
and educational programs, including city-sponsored scholarships.

WEST PALM BEACH - Has the fat lady sung at Opera Place?
A New York-based hedge fund confirmed it has contracts to buy two troubled
downtown properties, including land belonging to the still-unbuilt Opera
Place condo, the largest private development planned downtown since
CityPlace. CityPlace merchants complain of sagging sales behind fewer shoppers.
But none of that seems to bother Stillwater Partners. In its pitch to
investors, Stillwater characterized West Palm Beach as "perfectly situated
to become the next major city in Florida."
Stillwater has a contract to buy the vacant Opera Place parcel for $43.75
million and turn it into a mixed-use project including offices, stores, a
hotel and some condos, according to documents being sent to potential
investors of the hedge fund.
The hedge fund also has a contract to buy the troubled 1515 Tower condo on
South Flagler Drive for $35 million, the documents stated. Stillwater wants
to raze the storm-ravaged building and turn it into a luxury condo.
The 1515 Tower was badly damaged during the 2004 hurricanes, and frustrated
condo owners have been seeking to sell their units outright. A deal to sell
the tower for $56 million to another buyer recently fell through.
The contracts for Opera Place and the 1515 Tower still are in the
preliminary stages and are not done deals, cautioned Stillwater partner Jack
Doueck. He would not talk further, saying, "It's a little early."
But the agreements are the first indication that Opera Place might not be
built as planned. Construction on the 3-acre site along Lakeview Avenue was
to have begun this summer. But so far, no work has started on the project.
Willy Bermello, president of Miami-based BAP Development - Opera Place's
developer - did not return a phone call and e-mail seeking comment on the
status of Opera Place and the existence of the Stillwater contract.
However, observers say the Opera Place deal reflects the troubled nature of
the condo market, both locally and in South Florida as a whole. Indeed, like
Opera Place, several West Palm Beach condos have been delayed or canceled
for reasons ranging from rising construction costs to balky lenders to
disinterested buyers.
"West Palm Beach was caught off guard with the speed at which all these
units were being developed," said Neil Merin, chairman of NAI/Merin Hunter
Codman in West Palm Beach, and one of the area's top brokers. "But it's not
an unlimited market where you could put up anything and sell it."
In an interview Wednesday, West Palm Beach Mayor Lois Frankel said she was
familiar with the Opera Place deal but would not discuss details.
Frankel, however, cautioned not to read too much into the fact that some
condo projects might not move forward as planned. "If we have one less
condo, so what? We have so many other things going on," said Frankel, citing
the new library, a new office building and plans to redo the waterfront.
The condo market was so crazed with new entries, Frankel added, "For people
who live here, it was almost too much at once."
There are 1,355 condo units under construction in West Palm Beach, according
to Chase Scott, a spokesman for the mayor. But a total of 4,889 units are
planned or under construction in West Palm Beach, according to Jack McCabe,
chief executive of McCabe Research and Consulting in Deerfield Beach.
At the center of that condo boom was Opera Place. The project called for two
26-story towers, containing a total of 536 lavish units. Prices were high,
from $300,000 to $4.5 million. Buyers were promised big perks, including
massage suites, spinning and yoga rooms and an infinity-edge pool. Another
selling point was that Palm Beach Dramaworks planned to move to a 240-seat
theater in the ground floor of the project.
BAP paid $16 million for the Lakeview Avenue parcel in 2004. The land was
formerly owned by the Palm Beach Opera. Despite some opposition, BAP won
city approval to build extra-tall towers on the site.
Indeed, Opera Place would have been the tallest building downtown since the
downtown master plan was adopted in 1996.
In recent months, reports have circulated in real estate circles that BAP
was trying to partner with another developer on the project, or else sell
the site outright. In an e-mail sent in February, Bermello denied Opera
Place was for sale. "All of our activities at Opera Place are aimed at going
vertical with construction in the summer of 2006."
Now, summer has come and gone with no construction start. And Opera Place
buyers are antsy.
"What bothers me is they don't communicate. They don't let you know why
there is a delay," said Dan Palmon, who put $180,000 down on a $950,000
Opera Place unit.
Last week, a frustrated Palmon called the Opera Place sales center. He said
he was told the first tower would proceed as planned, but the second tower
was being canceled because the developer could not get the necessary sales
to satisfy its financiers. Palmon said he was also told deposits for the
second tower were being returned.
Sales director Lisa McKeon did not return a phone call on Tuesday seeking
comment. But earlier this month, she said the project was still waiting on
its bank loan. She said the first tower was about 85 percent pre-sold but
the second tower was only about 60 percent pre-sold. "As far as I know we
need a little bit more" in the second tower to qualify for a bank loan, she
said at the time.
Opera Place was to have been BAP's second condo in West Palm Beach. It
recently completed 610 Clematis. BAP also was working on plans to develop
Harbourside in Jupiter. But earlier this year, BAP called it quits and sold
the land, saying it had given up trying to win town approval.

In a recent article in Las Olas Magazine, Donald Trump was quoted as saying the South Florida market was “excellent, amazing and I have no complaints”. He further commented that the future of South Florida real estate was “bullish” to say the least. In answer to the question of “Where is South Florida going to be in 10 years?, the dynamic developer, who has several successful projects in South Florida, noted that “Florida has the best weather of any state. The beaches are the best and the water views are beyond compare.” Recently Trump has combined with South Florida’s Jorge Perez to build and develop Trump Hollywood, a luxury all glass condominium which has over 60 per cent reserved at this time. Units are going for over $1,000 per square foot and start at $2,000,000. So much for a weak market.
A recent Inc. Magazine study showed why Florida remains and will remain at the top of job creation cycle by placing four cities in the top ten list, led by Ft. Lauderdale which came in second to Las Vegas in the large city category. Orlando was ranked third and West Palm Beach-Boca Raton came in fourth. Tampa-St. Petersburg was ninth on the survey. Jacksonville narrowly missed the top ten by ranking 11th, while Miami-Miami Beach rounded out the top twenty by coming in 18th. According to the highly respected survey Ft. Lauderdale growth was attributed to several high-tech businesses relocating there due to the low tax climate. Technology, bio-med, and health services top the list of growth industries. West Palm Beach was spurred by a 20% increase in business and professional services jobs since 2002. Also driving the increase in the region’s economy is the dramatic growth in bio-med and life-sciences with the prestigious Scripps Institute forming a nucleus for further expansion in these high paying arenas. Miami’s surging economy is enhanced by Latin American and South American trade and the area is starting to attract more and more trade with China and Europe.

On June 6th the West Palm Beach Planning and Historic Board held a joint workshop to discuss "Mc Mansions" - large homes being built in the city, either by teardowns or additions on existing homes. The joint committee recommended that a six month Zoning In Progress be placed on all construction and building additions to homes in the historic neighborhoods. The City Commission plans to have the first reading on this issue June 19th.
The Zoning In Progress would reduce the size that a home can be built by up to 55% of what is currently allowed. The ordinance would apply to historic homes and noncontributing structures located in historic neighborhoods.
Due to the current market, any new restrictions on real estate, especially a Zoning In Progress, will have a devastating effect. A Zoning In Progress damages the economy, erodes property rights and prevents redevelopment. Many of West Palm's older homes do not fit the lifestyle of today's families. The restriction on home size harms neighborhoods and the quality of life of West Palm Beach families.
RAPB is contacting Commissioners to request a 60 day delay in adoption of the Zoning In Progress in order to give residents and industry time to work with City staff on possible solutions. Establishing a taskforce to address this issue in a comprehensive manner is a much better method then instituting another Zoning In Progress.

On Wednesday April 13, 2006 the Riviera Beach Community Redevelopment Agency voted and approved a plan to develop the Ocean Mall on Singer Island. A joint venture development company consisting of Catalfumo Construction, Marriott Vacation Club International, Norton Herrick and Andrew Brock will build a 28 story hotel with 60,000 square feet of shops and restaurants. The City of Riviera Beach, who owns the land, will wait for an official site plan before granting the final decision. Residents of Singer Island voiced some opposition to the project with regards to the height of the tower but the CRA voted 4-1 to approve. “This is an exciting time” said Catalfumo, “We are ready to start pouring concrete.”

PALM BEACH COUNTY, Fla. -- Homeowners desperate to repair cracked or broken roof tiles are taking matters into their own hands. Literally.
"People are going to places where roofs are being repaired to try and get salvaged tiles that are not damaged," said Robert Bryson, an associate broker with Mersky Realty Group. "It's, 'Hey can I have a couple of roof tiles?' Because they can't get them anywhere else."
Clay: It's the new gold.
An unpublished survey conducted by the Florida Roofing, Sheet Metal and Air Conditioning Contractors Association reports that since late 2004, the cost of clay roof tiles has doubled from $500 to $1,000 per 100 square feet. At about $700 per 100 square feet, concrete tiles are a little less expensive, but you'll need to take a number and be seated: Delivery delays that last year stretched from six to eight months are now running between nine months and a year.
True, those figures all include partial installation. And Steve Kolter, whose Delray Beach-based Kolter Project Management Inc. represents developers, said the prices he is seeing for barrel tile are lower, about $600.
Still, he said, "It's highway robbery."
Kolter doesn't blame manufacturers. In fact, roof tile plants are running at full capacity, and new ones are starting. Stuart-based Entegra Roof Tile Corp., for instance, is expected to have its new Okeechobee concrete tile plant open for business within several weeks.
The problem, said Steve Munnell, executive director of the state roofing association that conducted the survey, is that "you have got this huge market for new residential construction and now this hurricane recovery market, and the combination of those two things is just more than the tile man can handle."
In a cooling real estate market full of hurricane-battered roofs, the combination of high prices and slow delivery can quickly add up to trouble. Bryson cites the case of a would-be Jupiter home buyer who discovered her new house had just enough loose concrete tiles to put the purchase in limbo.
No insurance company would write a policy unless the roof was replaced. Prices quoted were running about $1,000 per 100 square feet. She couldn't afford it. The seller's insurance wouldn't pay for it. Even if it had, Bryson said, "We have been told by two different companies that it will be upwards of a year" before they can be delivered.
New construction has its own set of problems. Roof tiles, not shingles, are the material of choice for many high-priced high- rises, and many of those are already struggling with hikes in building expenses. A Boynton Beach condo, for instance, recently returned reservation money to buyers after the developer cited "meteoric rises in construction costs."
Costs can rise even further if tiles aren't placed on a roof. The life span of the waterproof covering beneath tiles can be shortened by exposure to Florida's high heat and summer rain, said a spokeswoman for Polyglass USA, which makes such underlayments.
Bob Landrum, regional manager for building-material distributor Bradco Supply Corp. -- which has several locations in Palm Beach County and the Treasure Coast -- believes that much of the supply squeeze will be eased within the next year. Until then, he advises patience.
"Most wanting repairs will not get the color they want," he said. That's not a small issue. Deed-restricted communities may allow homeowners to repair roofs with just one scarce color, or one type of hard-to-get roof tile.
"We have a few members who still have blue tarps on, not from Wilma, but from two years ago because they can't get the tiles they need" to appease homeowner associations, said Jan Bergemann, president of Cyber Citizens for Justice, a statewide property owners' rights group.
Insurers and general contractors are almost as unhappy. When contractors provided repair estimates after Hurricanes Jeanne and Frances, "insurance adjusters would look at the (roof repair) dollars and say, 'No way.' They thought there was price gouging," Munnell said.
The result was a meeting of insurance, construction and state officials that led to creation of a published guideline for what homeowners could reasonably expect in the way of home repair costs.
But those were last year's prices. A spokesman for the Florida Department of Financial Services said it will be compiling another list this year.

The league's Senior division also won a national title the year before, paving the way for several players who went on to play college or professional baseball.
Both victories were born of determination, talent, and heart, which are the defining traits of East Boynton's program. The 2003 Little League U.S. Champions rose to every challenge with integrity before falling to Japan in the World Championship. Even in defeat, these players showed great sportsmanship by rushing the field to hug, jump and rejoice with their rivals.
They brought national attention to Palm Beach County, and inspired young baseball players throughout our area to believe that they too could capture this once in a lifetime moment.
The following year, hurricanes Frances and Jeanne ravaged East Boynton's fields -- knocking down fences and light fixtures, shredding netting and shade canopies, and delaying the start of the 2005 Spring season. Repairs were costly and slow, but through persistence and determination, the dedicated volunteers worked around the obstacles to complete the season. By the Fall Season, all repairs were still not complete.
On October 24, 2005, East Boynton's Fall Season ended abruptly once more as Hurricane Wilma struck with intensity beyond the previous year's storms. Wilma thoroughly destroyed East Boynton's fields, downing huge concrete light poles, tossing apart bleachers, decimating the batting cages and causing the roof of the clubhouse to fall apart.
Little League Park has been closed, and the clubhouse, which houses the concession stand, the league's main source of revenue, has been condemned. East Boynton's promising program has been left in limbo. To survive, East Boynton Little League needs to locate funds, materials and volunteers who can donate their services, such as contractors, roofers and builders, to repair its ballpark.
Although the property is owned by the City of Boynton Beach, the league is mostly responsible for maintaining its facilities. With the city's budget stretched thin over the past two hyperactive hurricane seasons and facing over $100 million in overall damage, they lack the funds to help repair the extensive damage to Little League Park.
The League launched a volunteer-driven initiative requesting donations to help rebuild its facilities. You can help. Your assistance can take the form of tax-deductible company sponsorships, private gifts, donated materials or volunteerism.

We are slowly pulling ourselves from the dark ages that Hurricane Wilma left us with after Monday's storm. Most of us still are without power or are running on generated power. We will be slow to update the site over the next few days but hope to get things back to normal starting early next week.

To some, the advantages of qualifying for a homestead exemption is so attractive they figure they should have the savings on more than one home. The fact is that this breaks the law. Many Property Appraiser across the state have stepped up investigations into fraudulent filings. The homestead exemption reduces the taxable value of a property by $25,000.
Property appraiser's offices uses several methods to verify exemption status, the most effective tool is talking to a homeowner's neighbors. Also, once a year, the appraiser's office mails cards to residents with exemptions asking if they still qualify for the $25,000 "savings. If the mailing address is invalid and the card is returned it triggers an inquiry.
Property appraisers are also calling to other counties and states to see if a person who owns more than one home already has a homestead exemption.
State lawmakers do not want to be lenient on such errors, intentional or not. Currently there is legislation that has been proposed that would make it a felony to claim more than one homestead exemption. The offense is a third-degree misdemeanor. The property appraiser can recoup taxes on nonqualified homesteaded property dating back 10 years. There is a 50-percent penalty on the overdue taxes, plus 18-percent interest. The property appraiser also puts a lien on the property until the debt is paid. A second proposed bill would allow a married but separated couple to file separate homestead exemptions if both are paying their own bills.

Florida Insurers have been required to offer policyholder discounts for wind-protection features many homes already have or can easily be added since 2002. However, most homeowners in Florida still don’t know about these discounts.
In May a new law was passed that requires Insurance companies to list what is covered under the policy and what discounts may be available to the policy holder. If a home has shutters and a reinforced roof the premium may be up to 43% less than a similar home without these upgrades. It can be as simple as filling out a few forms and having the home inspected.
Discounts can start with the basic design of the home and the roof. Home with “hip” roofs are more likely to qualify for discounts over those with gabled roofs. Hip roofs allow the air to easily flow over the home because all sides slope up. Conversely, if a gabled roof has vertical surfaces and protrusions that allow for the wind to catch on them and theoretically rip the roof from the home in very high winds if such a home is not properly braced and reinforced.
Another consideration the Insurance companies give is the type of roofing materials used in the construction of the home. The types of straps or clips that are used to secure the roof, trusses and walls can affect the premium. Even the length of the nails used in the roof can get you a discount. Since Hurricane Andrew in the mid 90’s, the South Florida building code has required 2.5-inch roofing nails. Previously it was 2-inch. Of course a main consideration is what sort of prevention is on the openings. If you home has hurricane shutters or impact resistant windows and doors chances are you qualify for a discount.

Summer is vacation season, and when Florida gets steamy, many residents head north. Here is a list of safety tips created by FAR (Florida Association of Realtors®) to get you prepared.
Crime rates across the country often start to peak as temperatures rise during warm weather months -- the same time that many families leave their homes unoccupied and unprotected.
"Their home represents a huge financial investment for most people, but it is also the place where they raise their families, build memories and share their dreams for the future," says Florida Association of Realtors® (FAR) President Frank Kowalski. "It just makes sense to take steps to protect something so priceless."
The following homeowner strategies make a home less of a target for criminals:
• No "Home Alone": Before leaving your home during the day, make it look as if someone is still at home by using timers on lights in various rooms. Even though daylight hours are longer during the summer, it may still get dark faster than you expect or you may return home later than anticipated, and taking this step ensures that your home appears occupied at all times.
• No Open Door Policy: Make sure all doors leading to the home and garage are locked, even when leaving for short periods of time. The typical burglary takes less than five minutes, and unlocked doors, combined with an empty home, put out the "welcome mat" for crime.
• Someone to Watch Over Me: Be landscape smart. Shrubbery and other plants can grow very rapidly during the warm, wet summer months, so keep them trimmed to allow your neighbors to keep an eye on your home. Also, an unkempt yard could be viewed as a sign of an empty home to a burglar.
• A Key Reminder: When leaving home, take your house keys along or leave a spare set with a trusted neighbor. Never leave a key under a welcome mat, in a mailbox or other hiding spots -- most burglars know where to look.
• Crime Doesn't Take a Vacation: If you're planning to be away from home for more than a day or two, ask a neighbor to park a car in your driveway and pick up your mail and newspapers -- or be sure to make arrangements to cancel the paper and hold the mail. Disable your garage door opener and manually lock it from the inside, and don’t forget to check that the door leading from the garage to the home is locked, too.
This list as well as a little common sense will help to reduce the likely hood of your home appearing to be a good target.

1,600 apartments are being converted into condominiums in Broward and Palm Beach counties, with a real estate value over $240 million. McCabe Research and Consulting President Jack McCabe attributes the popularity of condo conversions to low interest rates and investors looking to engage in what he calls "rental carryover situations," though he expects a slowdown in both conversions and unit price-appreciation by the end of the year.
According to McCabe, "The future numbers won't work for the small investor at today's locked-in rental rates and developers will be wary of the bidding wars for the few good properties left for conversion." Condo conversions in 2004 led to an 8.4 percent decline in the number of rental units in the region, and McCabe expects that number to increase this year.

Location is always important when buying a house, especially for homebuyers choosing a home and community for their family and children. While quality public schools are an important consideration, many parents and demographers list six criteria that define a town as best for families with children.
Dr. Andrew Schiller, a specialist in American demographics and creator of the NeighborhoodScout search engine, analyzed government data to identify the Florida communities with the best overall combination of attributes parents and researchers cite as important. He combined data from the National Center for Education Statistics, the U.S. Bureau of the Census, the FBI, the U.S. Justice Department and the Office of Federal Housing Enterprise Oversight to create a list of the top 10 Florida communities for families with children.
The criteria used included quality public schools, safety from crime, a high proportion of families with children in the community, many adults with college degrees or advanced degrees, many families who own their homes and homes that are predominantly single-family residences, regardless of the setting being urban, suburban or rural.
Schiller's top 10 list in Florida includes:
1. Windermere
2. Boca Raton
3. Winter Springs
4. Key Biscayne
5. Longwood
6. Orange Park
7. Fort Lauderdale (chiefly west of the Florida Turnpike)
8. Jupiter
9. Oviedo
10. Naples
The top towns range in price, setting and location, and are located from the Jacksonville area to South Florida. The panhandle was included in the research, though no towns made the top ten.

According to property records, the Celine and her husband recently paid more than $12.5 million for a waterfront home on 3.7 acres in the 200 block of South Beach Road. Public records show the property was sold earlier this month to Renlec Management Inc., a Canadian firm.
The address listed for Renlec is the same as Quebec-based Feeling Productions, the artist-management company run by Dion and her husband, Rene Angelil. In addition, a couple of years ago, the famous couple sold their Jupiter home — in Admiral's Cove — for $9 million under the name Renlec Enterprises Inc. Only two years ago, the French-Canadian singer paid$3.5 million for waterfront property in Bear's Club, Jack Nicklaus' golf course development in Jupiter. Dion is not the only familiar face to settle in town.
Other famous Treasure Coast residents include musician Tori Amos, country music star Alan Jackson, golf pro Greg Norman, actor Burt Reynolds and fellow music diva Gloria Estefan.

The Riverwalk will now offer pedestrians fewer retail miles along its waterfront.A chunk of the mini-shopping mecca planned for visitors to the Riverwalk's south end has been turned into a commercial office plaza, surprising town officials.The tiny enclave of shops and restaurants envisioned in the Jupiter Yacht Club is on the first floor of the building. The Mariner building was intended for crowds who wandered past the Indiantown Road bridge.Instead, a stock broker, a yacht broker and the current landlord occupy the first floor of a five-and six-story residential condo high-rise.
Town officials claim a swift move by the Yacht Club's developer, WCI Communities Inc., went largely unnoticed by the town and managed to eliminate the retail shops. The development group owns five buildings on the site at 400 U.S. 1, just south of the Indiantown Road Bridge. Originally, The Mariner building was eligible for dual retail and commercial office zoning.
The initial site plan requested the town's approval only for retail use in The Mariner building. However, the final statement of use the town approved also included commercial offices for the roughly 7,000 square feet of building space. The Mariner building was completed in April 2003. Town officials now want the development group to rectify the situation by replacing the office space with retail shops when the lease expires.
Town staff and representatives for the development group are scheduled to meet to discuss the occupancy of another building in the Jupiter Yacht Club planned for retail shops.
Town officials have planned for the entire 2.5 mile Riverwalk project, the area west of U.S. 1, along the Intracoastal Waterway as an environmental and retail attraction. Still years away from completion, the latest phase of the Riverwalk will unveil an entertainment plaza under the Indiantown Road bridge by summer's end.
In anticipation of The Mariner building, the town added public restrooms for pedestrians and allowed the building to be five and six stories high. A sprawling entrance forms a circular brick-paved driveway leading into the Jupiter Yacht Club.
New owner Richard H. Cullifer, who bought the first floor of The Mariner building, thinks replacing the offices with shops and restaurants now would be a hardship on visitors. They would have to use a shared parking lot on the north side of the Yacht Club's entrance. Cullifer considers businesses such as the yacht sales office to be a better use of the retail space since it faces the waterfront where the company can dock the boat models on sale.
The lost retail space has town officials eyeing the Yacht Club's newest two-story building to ensure it will be used exclusively as retail space. Still under construction, the building is zoned on the first floor for retail shops with possible commercial offices on the second floor. Officials have requested notification of any attempt by WCI Communities Inc. to put offices in the new building.

Florida Travel & Life magazine named St. Joe Co.'s SouthWood development in Tallahassee as No. 1 on its list of "New Urban Communities to Watch," which appears as part of an article on planned Florida communities in the publication's Spring 2005 issue. "Families, young professionals and retirees are recognizing the benefits of living in a community that offers a wealth of life, work, learn and play options, " Rod Wilson, president of Northwest Florida for St. Joe's residential operations says. Coming in at No. 2 is Town of Tioga, Gainesville; followed by Baldwin Park, Orlando; Botanica, Jupiter; and Aqua, Miami Beach.

Hotel, convention center, office buildings in the works for Abacoa
On the horizon for Abacoa are the next two major pieces of the Abacoa master plan, the long-touted hotel and convention center across from Roger Dean Stadium and the mixed use and professional buildings that will be built on 15 acres of land just north of the stadium, where people now park to go to the baseball games.
The site plan is expected to be submitted for the mixed use and professional buildings in July or August.
The hotel will be a condominium hotel, it will look and run like a hotel, but people will own the space and then turn it back to be part of the rental pool. Adjacent to the hotel will be a 20,000 square foot conference center, which will be used for many functions, including weddings. North of the stadium, the developers Rendina and de Guardiola envision two professional buildings, each containing 100,000 square feet. In addition, there will be four restaurants, two on either side of the professional buildings, and retail with condominiums above. However, they won't have condominiums above the restaurants. We've learned about that," Rendina said. He added that at the end of this street, where it meets the residential areas just south of Indian Creek Parkway, he plans to have a pool, spa, fitness center and additional parking.
Right now, according to David Kemp, senior planner for the Town of Jupiter, there are 3,135 units completed in 12 Abacoa developments. But others are in the pipeline, either approved by the town, about to be approved or under construction and being sold. Those include 480 units in Martinique, 139 for Abacoa Dakota, 230 in Canterbury, 174 in Greenwich, 370 proposed for the final Town Center area project and 700 in two sister developments, Windsor Creek and Windsor Park. Jupiter officials said that all these living units will bring the total to more than 5,000, instead of the original 6,000 units planned for the community.

There is a new disclosure included in the property insurance law (CS/SB 1486) that took effect June 1. Sellers of real property -- commercial and residential -- for which an insurance claim for sinkhole damage was made must disclose to buyers (1) that a sinkhole claim was paid and (2) if the full amount of the proceeds were used to repair the sinkhole damage. The law doesn’t specify the type of disclosure (written or verbal) or when to make the disclosure.

Perry & Co. has arranged for $14.9 million in acquisition and condo conversion financing for the Forest Club Apartments. The 120-unit rental community is at 711 Forest Club Drive in Wellington. The $15 million purchase price amounts to $125,000 a unit. The Forest Club rental project, built in 1987, has six two-story buildings with a net rentable area of 124,400 square feet. Sales of the individual units are expected to begin within 30 days, with sale prices ranging from $169,900 for the two-bedroom/one-bath units to $179,900 for the two-bedroom/two-bath units. Amenities for the project include two tennis courts, a swimming pool, a clubhouse, recreational area and 240 parking spaces. Interior units have ceiling fans, crown moldings, full washer/dryers, patios and balconies.

Tequesta marina owners said he plans to partner with WCI to expand Seagate Marina.
Robert Miller said he is in the process of expanding his waterfront commercial operations with a possible partnership with developer WCI. Since many marinas are disappearing and people are turning them into condos his plan is to do the opposite. Since WCI is a big player in marinas statewide, the partnership seems like a good move. The plan is to expand the facilities to add 350 dry racks that will give the marina a total of 800-boat capacity. Plans for the marina are in design stages and should be finalized soon.

Palm Beach County will be shutting down the bridge leading to Jupiter Island in Tequesta for repairs that will span 55 days beginning June 6th. Residents to the island however can find their way home by using the free water Taxi service that will operate daily from 6 to 10a.m., noon to 2 p.m. and 4 to 8 p.m. every 15 minutes. The pontoon boat will go from the south dock of the JIB Yacht Club Marina to the Crab House restaurant, off Sate Road A1A. Around six people will be able to make the trip at once. There is no plans to have service available for vehicles. Island residents can still take a detour by car through Martin County and cross the Hobe Sound bridge that requires driving north on Beach Road for 10 miles at 30mph and returning south along U.S. 1.

On Monday, Governor Jeb Bush signed legislation authorizing the first-ever 12-day sales tax holiday on hurricane-preparedness supplies. Being prepared for hurricane season can protect property and save lives. The Governor said “I hope this tax benefit will encourage Floridians to ready themselves, their families, homes and businesses for the 2005 hurricane season.” Florida taxpayers will save approximately $10 million during this sales tax holiday. Under the legislation, no state or local sales tax will be collected on certain hurricane-preparedness items from 12:01 a.m. June 1 through midnight June 12, 2005.

Students often ask “how can I improve my concentration, my mind just seems to wander when it comes to details or finishing a project”? Others say, “I can concentrate reasonably well but I am always in a rush to get the job done; how can I be more productive with the time I have? Will Feng Shui help”?
I explain that productivity and concentration are directly related through positive energy, and both are related to desire. In order to be productive you need to concentrate but in order to concentrate you need to surround yourself with the kind of energy that encourages and motivates you which in turn is nurtured by desire. Desire can be fed by many types of energy; income earned in return for the productivity, recognition given for a job well done or even internal acknowledgement that you are doing the right thing at the right time. There are many ways to improve productivity and concentration but one of my favorite suggestions is the short list that follows.
Number one; begin by creating a list of things you need to accomplish in the next seven days. Be sure to include everything; even trips to the grocery store, the gym, the dry cleaners, and the barber shop or hair salon along with going to work, dinner engagements and Sunday brunch. It’s the little details that often get in the way of concentration and productivity. Once you have created your list, no matter how long or short, rank everything you have to do in order of importance with the most important being number one.
Create a separate list for home and for work as each requires different energy and motivation.
Once you have completed your list, review it to see if you can possibly get all of it done in one week by mentally allocating the amount of time it takes to complete each task. If you can’t then re-evaluate the list and move what you can to the following week or try delegating that which others can do to family members at home or co-workers where you work. It is very difficult to be productive in a timely fashion if you are constantly thinking about everything else you have to do while working on your current project or being afraid that you might forget something important.
Number two; put your list in a prominent place that only you can see for regular reviewing. This too will help you remain more focused. Then begin with the most important item on your list. Set a time limit for how long it should take. It doesn’t matter if it is cleaning the house or meeting a production deadline for your boss at work, you will be 100% more effective if you know that you only have a limited amount of time to work on your project. Complete that project before thinking about anything else on your list. Reward yourself after you’ve completed your project within the allotted time by a five minute break sitting in the sun with a glass of cool lemonade or taking a brief walk in the fresh air. The reward is a very important step as it is part of your motivation.
Now move onto the next item on your list. Be sure to review your list periodically throughout the week and evaluate whether you have estimated the proper amount of time to complete the list. You can always move an item to the next week or bring one forward as time permits. If people stop by to visit with you to discuss their current issues, be polite but tell them “you are on a deadline and could you get back with them”. Do it at a time that would be more appropriate for your timetable, not theirs.
Number three, it is also important to energize specific areas of your home and office to give you the supportive positive energy needed to concentrate better and be more productive. In the northwest area of your office and living room place a motivational picture framed in silver or a silver statue. It could be a picture or statue of the car you want to buy or someplace you would really like to travel for total relaxation; perhaps a cruise, or buying a new home. The combination of the silver and picture will help focus energy on both motivation and the helpful people you need in your world. In the south area of your home and office place something triangular, red or a candle. The red could be a splash of color in a picture hanging on the wall, a glass vase or even a triangular paperweight on your desk. The color or shape focuses positive energy on the fame and good fortune area of your home and office which further energizes both productivity and desire.
Follow this simple procedure weekly and your productivity and concentration will improve dramatically. It is very easy to become distracted by noise pollution, the television and the call of the beach or friends to say nothing of the demands of your family and boss. These three simple steps will make it much easier for you to be more productive, meet deadlines and concentrate.

After four days in Special Session, the Florida Legislature adjourned, Sine Die, this afternoon after passing legislation regarding Hurricane Relief, Universal Pre-K, Florida KidCare, and Juvenile Detention.
Hurricane relief was the subject of many bills this week - nearly $500 million was appropriated for those hit hardest by the named storms Charlie, Frances, Ivan, and Jeanne. Floridians who paid property tax on homestead property that was deemed partially or completely uninhabitable are eligible to receive up to a $1,500 rebate on those taxes from the state by applying to their local Property Appraiser by March 1, 2005. The Legislature also approved a measure to reimburse those homeowners who paid more than one deductible as a result of damage caused by two or more named storms. The bill provides for a reimbursement of up to $10,000 for the second deductible and up to $20,000 for those facing three or four deductibles. Another provision in the bill stipulates language for annual hurricane deductibles rather than those per peril.
The requirement for a Universal Pre-K program passed as a constitutional amendment in 2002 and is slated to be running by the fall of 2005. While the legislature passed a bill in regular session earlier this year, the bill was vetoed by Governor Jeb Bush who didn’t think the legislation went far enough for Florida’s children. The bill passed today will provide 540 hours of instruction during the school year and provides for two adults for any classroom with more than 10 students.
Much needed beach renourishment appropriations were made to help those areas hit hardest by the pounding waves during the busy storm season. Over $68 million was provided to help local governments repair those areas.
Falling under hurricane relief, bills passed regarding agriculture losses, canker eradication, health and human services, juvenile detention centers, and relief for displaced workers as a result of the storms.

Just one more reason to buy a home in Florida, you may now deduct Florida sales taxes from federal income taxes in 2004 and 2005. The recently-signed American Jobs Creation Act (AJCA) of 2004 resurrected a sales tax deduction last provided to taxpayers back in 1986. Prior to the Act's effective date, taxpayers generally could deduct only income, real estate and certain personal property taxes imposed by their state or locality as an itemized deduction on Schedule A.
This is good news to taxpayers especially those living in a state such as Florida that does not have a state income tax. Taxpayers living in other states may also deduct sales taxes from their federal forms, but they must choose between the sales tax deduction or a deduction for their local and state income taxes however, you cannot deduct both.
In planning to make the most of this provision, taxpayers may want to schedule major purchases simultaneously to ensure itemized deductions exceed the standard deduction for a particular year. Depending on their tax bracket and other issues present in their tax return, taxpayers should also consider whether they should schedule their purchases for 2004 or 2005. In all cases, taxpayers should consult their accountant before making any decisions that could impact their tax payments.
Florida taxpayers may deduct the actual amount of sales taxes paid or, if easier, deduct a standard amount as determined from a table currently being developed by the IRS. Additionally, the taxpayer may start with the table's standard deduction and increase the deduction amount by the level of sales tax paid on some big ticket items, such as a motor vehicle, boat or other large item soon to be defined by the IRS.

The developer of The Lucerne recently broke ground on a condominium project in downtown Lake Worth which is the first new condominium to be built in the downtown area in more than 20 years. Located at 531 Lucerne Avenue, Lucerne is in the heart of the city's downtown and within its community redevelopment area, featuring two- and three bedroom units on the approximately one-acre site.
Units at The Lucerne will have European cabinetry, premium appliances, walk-in closets and granite or marble countertops. Units will range from 700 to 1,500 square feet and are priced from the $250,000s to the $400,000s.
Building amenities will include a pool and spa, fitness center and a parking garage with security-controlled access.
Sales started last November and to date, about 80 percent of the units have sold to buyers that include locals and out-of-town buyers across all age groups. In addition to the residential units, The Lucerne also will feature about 6,000 square feet of retail space.

The order of Passionists priests has sold some of its waterfront property to Kolter Property Co. a developer planning more luxury condominiums. The $23.5 million bought 7 acres overlooking the Intracoastal Waterway in North Palm Beach.
The land is part of the 27-acre Our Lady of Florida Spiritual Center, operated by The Passionists of Saint Paul of the Cross Province in New Jersey. The spiritual center, which is not part of the sale, will undergo major repairs and renovations. The property is currently zoned for 77 residential units. The plans call for a project of $1 million-plus condos and could begin next summer. The project will be called Domani and will be similar to One Watermark Place, the 48-unit luxury condominiums built by WCI Communities along Flagler Drive in West Palm Beach.

Palm Beach Gardens Downtown Project is Underway. Downtown at the Gardens is the 60 acre project on the northeast corner of PGA Blvd, and Alternate A1A has started construction. Downtown will include 336,400 square feet of retail space, with a 3,200 seat, 16 screen Cobb theater, nationally known restaurants and specialty retailers.

Jupiter Farms residents have voted to pave 19 roads which some see as rural lifestyle slipping sway and others glad to get rid of the dust. This famous riding community is totally in favor of this move because some feel that paving materials creates uneven footing for horses and makes for very unsafe riding. Officials Break Ground on Jupiter Riverwalk Retail Project. Riverwalk in Jupiter is one more step closer to reality with the ground breaking of the Shoppes of Riverwalk. Located on U.S. 1 just south of the Indiantown Road bridge this new facility will consist of 23,500 square feet of retail stores and restaurants that will be accessible by land and water. The Shoppes facility is immediately adjacent to the yacht club’s marina and will have 10 slips for visitors.

Coming soon to the $200 million retail-lifestyle center scheduled to open late next spring in Palm Beach Gardens are The Strip House, Yard House, and Old Original Bookbinder’s. The first is a steakhouse voted Manhattan’s finest. The second is a trendy restaurant chain famous for its draft beer and classic rock songs. The third is a 139-year-old world-renowned seafood eatery from Philadelphia.
These restaurants will join Cobb Theatres and Whole Food Market, two previously announced anchor tenants at the new project, just west of The Gardens Mall in Palm Beach Gardens. The goal of the developers is to bring new chains to the area that people do not see everywhere that they go.
This will mark The Strip House’s first restaurant in Florida. Though not for everyone, the approximate $100 tab per person will provide you with large portions and a funky and hip design with a trendy atmosphere.
Irvine California based Yard House won Nation’s Restaurant News’ Hot Concept award and doesn’t have any locations East of the Mississippi. The cool mix of mellow rock and island beers will help patrons kick back during lunch and dinner.
Philadelphia based Bookbinders’ opened in 1865 and has served both celebrities and a United States President. Bookbinders’ recently opened shop in Virginia and the historic Philadelphia location will be re-opening later this ear after major renovations.
Other tenants new to our area are the 1950’s style diner Johnny Rockets as well as Sur La Table, a home furnishings retailer. Not to be forgotten are some familiar names such as Starbucks Coffee, Max’s Grille, Sloan’s Ice Cream, Big City Tavern, as well as a less expensive versions of Palm Beach’s Bice.
More tenants will be announced later this year with the possibility of Italian, Mexican, and Poultry restaurants as well as various specialty stores. The goal is to have a nice mix of local and regional chains that cover the price spectrum so there truly is something for everyone.

The Census Bureau just released its latest estimates for population, demographics for each state as of July 1, 2003, and Florida ranks high in most of the categories. Florida was the fourth most populous state in 2003 with 17 million and added over 1 million between 2000 and 2003. the state experienced a 7 percent growth rate from 2000 to 2003, which placed it third for the highest growth rate during that period, behind Nevada and Arizona.
Florida ranked fourth for the highest number of adult residents 13.1 million and second for the most number of residents 65 and older 2.9 million. The state ranked third for adding the most adults 18+ residents since 2000 that was 759,000; third for adding the highest number of residents 65 and older 90,000; fourth for the highest total of elementary school-age children, 5-13 years, of 2 million; and second for the highest increase in that age group which was 88,000.

The Riviera Beach City council has adopted a controversial view for the future hopes of revitalizing the city. Community Redevelopment Agency officials recently unveiled their plans to raze much of downtown and build a City Place (West Palm Beach) type of environment.
However, the plans for the new city center will result in the relocation of about 5,100 people from some 2,200 home in order to carry out the plan. The redevelopment plans include re-routing Broadway (U.S. 1) to the west about a block and completely altering the look of the city center area. The new road will have several traffic-calming circles and commercial traffic will be rerouted away from the downtown area.
The development plans include businesses and homes along Blue Heron Blvd. from Ave. F east to the ocean and along Martin Luther King Jr. Blvd. north to Silver Beach Road.

Tequesta County Line Plaza will find a new 54,379 sq. ft. supermarket rising from the abandoned Kmart site and creating a new vacancy down the road. The plan is to demolish the Kmart and add the new Publix plus and additional 3,000 sq. ft. of retail space. This move is seen as a positive one with all the new condominium developments close by and the demand from Jupiter Island residents.

According to Inc. magazine, three Florida cities rank among the top 10 for entrepreneurs in which to do business. The list, which was featured in the magazine’s March issue, ranks West Palm Beach as Number 5, Fort Lauderdale-Pompano-Hollywood as Number 7, and Jacksonville as Number 8.
Florida outperformed all other states, with six cities included in Inc. magazine’s top 25 large metropolitan cities for doing business. Ranking were based entirely on data on job growth and diversity of industries in the cities, and didn’t include subjective qualities such as life style. Job growth accounted for two-thirds of the ranking and diversity of industries for one-third. Some of the most important factors were low housing and commercial real estate costs, business-friendly city governments and an affordable cost of living.

The former Burt Reynold’s Dinner Theater at 1001 E. Indiantown Road that has been closed for years has been gutted and almost totally renovated and plans to open its door under new ownersship. The Maltz Jupiter Theater has announced a series of one-night performances before beginning the first full production of the musical My Fair Lady, which will run from March 13-28. Money for the first phase came from private donations, including more than $2 million from Milton and Tamar Maltz, and $2 million from a countywide bond issue to provide more money to the arts and parks.
The theater has had overwhelming support, not only with donations but with hundreds of volunteers from the community. The 550 seat theater has all ready sold out three out of the four shows scheduled this season.

Elks Lodge moving from US 1 in Jupiter to make room for new development. The Elks Lodge 2469 located at 1222 S. U.S. 1 in Jupiter is moving to its new quarters to be built in Jupiter Farms Shopping Center on West Indiantown Road.
The lodge, which has been at its current location since 1971, has sold to Opus South, a national development company. The company has been talking with the Town of Jupiter officials about constructing a high-rise building with mixed-use residential and retail on the site. The waterfront portion of the tract is designated to become part of Jupiter’s Riverwalk project, to provide water access to Jupiter residents and visitors. Stay tune for more details.
